The petitioner herein is a defendant in a suit for possession by way of specific performance of the agreement to sell. The trial Court has permitted the plaintiff to produce additional evidence including an affidavit of his presence dated 02.05.2016 from the Sub-Registrar in order to show his presence on the agreed date and notice sent by him to the defendant and reply thereto.

No doubt, the case was at the stage of rebuttal and arguments. However, such documents are necessary for the proper adjudication of the case.

Keeping in view the aforesaid facts, no ground is made out to interfere. Hence, the present revision petition is dismissed. (Anil Kshetarpal) Judge September 06, 2022 "DK"
