Ms. Ramandeep Kaur, Advocate, for respondents No.4 and 5. **** Rajan Gupta, J. (Oral) Petitioner has impugned order dated 15.03.2017 passed by Additional District Magistrate, SAS Nagar. According to him, the authority has observed in operative part of the order that plea of the petitioner to seek eviction of respondents No. 4 and 5 would be outside the ambit of the Act. According to him, this observation is against the scheme of special enactment. It is prayed that the matter be remitted to the same authority for decision afresh.

Learned counsel representing the respondents do not object the prayer for remand of the case.

Under the circumstances, impugned order is set aside. Matter is remitted to the same authority for a decision afresh as per law after affording an opportunity of hearing to the parties.
