ARUN PALLI, J. (ORAL) The petitioner joined the Education Department as Math Mistress on 03.09.1984. She was subsequently promoted as Post Graduate Teacher in Economics in 2004. Whereas, one Kusum Gupta was appointed as Mistress on 01.11.1986 and was promoted as Post Graduate Teacher in 2006. Thus, it is maintained that the petitioner happened to be senior to her. Further, in terms of Note-7 of Rule 18 of the ACP Rules, 2008, it was clarified by the Finance Department that stepping up of the pay should be done for all the senior employees with effect the date on which the junior government servant moved into ACP structure and were granted higher salary/pay than the senior employee. The limited grievance of the petitioner is that she is getting lesser salary than her counterparts, who happened to be junior to her. And, although the petitioner had represented to the respondents numerous times in this regard, but to no avail. CWP-9337-2017 Pandit, Additional Advocate General, Haryana, has caused appearance on behalf of respondent Nos. 1 to 4. None appeared for respondent No. 5 despite service.

In response, learned State counsel submits that the claim as also the grievance of the petitioner, as set out in the petition, shall be considered and dealt with within a period of three months from today and appropriate orders, in accordance with law, shall be passed. That being so, the petition is disposed of in the above terms. Needless to assert that in the event the claim of the petitioner is declined, the respondent authorities shall pass a comprehensive order assigning reasons in support thereof.
