CWP-6676-2018 We notice that objections of the petitioners are totally frivolous as there are other ponds available to the inhabitants of the village. The Gram Panchayat has made provisions for recreational facilities for the residents of the village by opening a gym and constructing a stadium. CWP-6676-2018 (O&M) -2are of the opinion that though ponds are of public importance but the approach of the petitioners is totally obstructionist, in opposing the work of importance by the panchayat.
Petitioners pray for permission to withdraw the petition. Since a prayer for withdrawal has been made by learned counsel for the petitioners, therefore, the present petition is dismissed as withdrawn.
However, the amount of Rs.50,000/-, deposited by the petitioners, shall stands forfeited and given to Gram Panchayat to be utilized for the construction of a stadium for which the work is already underway.
