This petition has been filed under Article 226 of the Constitution of India seeking issuance of writ in the nature of certiorari for setting aside the report dated 14.01.2016 (Annexure P-4). A further prayer has been made seeking issuance of writ in the nature of mandamus for directing respondents No.2 to 4 to take necessary action by conducting a spot inspection/demarcation of the land in dispute. 2.

At the outset, learned counsel for the petitioner prays that he may be permitted to withdraw the instant petition with liberty to the petitioner to avail his remedies before the Civil Court by filing a civil suit. 3.

In view of the above, the instant petition is dismissed as withdrawn with the liberty aforesaid.
