The present appeal pertains to the year 2016 which is still at the stage of preliminary hearing. The case has repeatedly been adjourned on the request of counsel for the appellant. On 12.02.2020, the following order was passed :

"This is an appeal of the year 2016. Notice of motion has not still been issued.

Today again, a request for adjournment has been made on behalf of learned counsel for the appellant, on the ground that arguing counsel is not well.

In the interest of justice, adjourned to 22.04.2020. It is made clear that no further adjournment shall be granted. To be shown immediately after urgent." YOGESH SHARMA 2023.05.12 10:05 I attest to the accuracy and integrity of this judgment/order.

On 14.02.2023 the following order was passed : "Learned counsel for the applicant-appellant seeks some time to deposit the amount of Rs.25,000/-. Adjourned to 20.04.2023."

Today again a request for an adjournment has been made on behalf of arguing counsel for the appellant on the ground that the counsel needs some more time to comply with the order dated 14.02.2023. There is no ground made out to further adjourn the matter. It appears that the appellant is not interested in pursuing the present appeal. This Court is left with no other option but to dismiss the present appeal for non-prosecution. Dismissed for non-prosecution.
