By virtue of instant petition preferred under Article 226 of the Constitution of India, petitioners have sought issuance of a writ especially in the nature of mandamus, directing the respondents to grant family pension & ex-gratia benefits etc. after the death of their father by counting total service rendered by their father before regularization i.e. 01.01.2014 and to treat their father under old GPF Scheme which was applicable to the employees recruited in Punjab Government Service prior to 01.01.2004, in view of judgments of this Court dated 31.08.2010 (P-10), 14.07.2014 (P-11) and 07.01.2016 (P-12), 09.05.2016 (P-13) and 22.02.2017 (P-14).

At the very outset of the arguments, learned counsel for the petitioners submits that petitioners feel satisfied in case direction is issued to respondent No.2 to decide legal notice dated 04.01.2018 (Annexure P-15) Sonika 2018.03.20 10:36 I attest to the accuracy and authenticity of this document Chandigarh

Instant petition is disposed of with the direction to respondent No.2Director General of Police, Punjab Police Headquarters, Sector 9, Chandigarh to consider the case of the petitioners as set up by them in legal notice dated 04.01.2018 (Annexure P-15) and take a conscious decision in accordance with law, within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioners still feel aggrieved against the order passed by the concerned authority, they shall be at liberty to have recourse to the other remedies as well as to approach this Court.
