Notice of motion.

Mr. Arihant Goyal, Advocate accepts notice in the application on behalf of the non-applicant/petitioner.

Heard counsel for the Review Applicant/Bank and counsel for non-applicant/petitioner.

It is the contention of counsel for both the parties that when the Writ Petition had disposed of on 28.10.2021, there was a direction to the Registry of this Court to release a sum of
1 Lakh with the accrued interest thereon to the Writ Petitioner by 02.11.2021 for the purpose of making payment to the Review-Applicant/Bank, but in fact, the amount of
1 Lakh which had been deposited by the Writ Petitioner in the Registry, remained in the current account of the Registry maintained in the Bank, and had not been invested in an FDR, and so there was no accrued interest thereon which could be released by the Registry to the Writ Petitioner as directed in the order dt.28.10.2021.

It is further contended that the parties are agreeable if that sum of
1 Lakh, available with the Registry, is released directly to the ReviewApplicant/Bank instead of being routed to the Review-Applicant through the Writ Petitioner.

Having regard to the said submission, order dt.28.10.2021 is modified and the sentence therein, "Since the request of the petitioner is reasonable and it could enable the petitioner to settle its dispute with the respondent-Bank by making payment of the said amount of
1,00,000/- to respondent-Bank, this application is allowed and the Registry is directed to release the amount of
1,00,000/- with the accrued interest thereon to the petitioner by 02.11.2021 for making payment to the respondent-Bank."

is substituted with the following sentence:- "Since the request of the petitioner is reasonable and it could enable the petitioner to settle its dispute with the respondent-Bank, this application is allowed, and the Registry is directed to release the amount of
1,00,000/- to the respondent-Bank within one week from receipt of certified copy of this order, subject to the parties informing the Registry of Bank Account to which the transfer is required to be made." Review application is disposed of accordingly.
