The present appeal lays challenge to award dated 11.03.2011 passed by the Motor Accident Claims Tribunal, Narnaul whereby compensation has been awarded in respect of the injuries sustained by Mohit Kumar, minor in a motor vehicular accident that took place on 05.12.2009.
The learned Tribunal has awarded an amount of Rs.1,57,000/- under the following heads:- SR. NO. HEADS AMOUNT Disability Rs.14,000/- Pain and suffering Rs.15,000/- Medical expenses Rs.1,13,000/- Special diet, transportation, etc.
Rs.15,000/- TOTAL Rs.1,57,000/- The sole submission made by counsel for the appellant is that the Tribunal has not awarded any compensation for attendant charges.
I have gone through the discussions on issue No.2 and the findings recorded by the Tribunal in regard to entitlement of the Mohd. Yakub 2016.10.27 16:22 I attest to the accuracy and authenticity of this document Chandigarh
FAO No.7245 of 2015 (O&M) claimant to compensation under various heads. In view of the nature of injuries, period of treatment, I do not think it to be a fit case where any increase of compensation is justified. This apart, the present appeal has been filed after an inordinate delay of 1547 days without any satisfactory explanation that the appellant was prevented by sufficient cause from filing the appeal within the stipulated period. In view of what has been discussed hereinabove, the appeal is dismissed in limine.
