Present transfer petition, under Section 24 CPC, has been filed by the petitioner - wife, for seeking transfer of the petition, bearing No. HMA/123/2023, filed by the respondent - husband, under Section 13(1)(i-a), 13(1)(i-b) and 13(1)(iii) of the Hindu Marriage Act read with Section 7 of the Family Courts Act, 1984, titled as "Sahil Rohilla v. Lalita", presently pending in the Court of Principal Judge, Family Court, Panchkula, to any Court of competent jurisdiction at Rohtak.

At the outset, counsel for the applicant-petitioner submits that parties have entered into compromise, and as per the terms of the compromise, firstly, applicant-petitioner (wife) is required to withdraw present transfer petition, and thereafter, respondent-husband would withdraw the divorce petition filed by him. Therefore, he seeks withdrawal of present transfer petition.

Mr. Krishan M. Vohra, Advocate, puts in appearance on behalf of the respondent, and files his Vakalatnama, in Court today, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place.

TA-1073-2023 - 2 - Counsel for the respondent also affirms the factum of compromise having been effected between the parties and pleads no objection to the prayer made by counsel for the applicant-petitioner. 4.

Taking note of the statement made by counsel for the parties in Court today, present transfer petition is ordered to be dismissed as having been withdrawn.

However, liberty is granted to the applicant-petitioner to get this petition revived, in case the term of withdrawal of the divorce petition is not met with by the respondent-husband.
