(ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioners in FIR No.0185 dated 28.08.2018 registered under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Sangat, District Bathinda.

Learned counsel for the petitioners submits that petitioners were arrested in the aforesaid FIR on 28.08.2018. They were granted regular bail by the trial Court vide order dated 28.09.2018. Petitioners were regularly appearing before the trial Court. However, due to outbreak of Covid-19 pandemic, the Courts were working in restrictive manner, therefore, petitioners could not appear before the trial Court on 10.09.2021 and 27.10.2021. Therefore, bail bonds and surety bonds of the petitioners have been cancelled and forfeited to the State by the trial RAVINDER SINGH 2021.11.22 14:50 I attest to the accuracy and integrity of this document

-2CRM-M-48679 of 2021 Court vide order dated 27.10.2021. The petitioners have been summoned through non-bailable warrants. Challan has been presented and charges have been framed. Now the case is pending for prosecution evidence and fixed for 22.12.2021. Learned counsel for the petitioners submits that petitioners are facing trial since 28.08.2018 and are ready and willing to face the trial.

Notice of motion.

On the asking of the Court, Mr. C.L. Pawar, Sr. Deputy Advocate General, Punjab, accepts notice on behalf of the State and opposes the grant of anticipatory bail to the petitioners. I have heard learned counsel for the parties and perused the paper-book.

Considering overall facts and circumstances of the case, present petition is disposed of with direction to the petitioners to deposit `5,000/- each as costs before the District Legal Services Authority, Bathinda, and to surrender before the trial Court on or before the next date of hearing i.e. 22.12.2021, along with receipt of deposit of costs. On doing so by the petitioners, the trial Court shall admit the petitioners to bail on their furnishing bail bonds and surety bonds to its satisfaction. November 22, 2021 (ASHOK KUMAR VERMA) R.S.
