IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No.9689 of 2017 Date of decision:05.05.2017 Mamta Rani

...Petitioner

Versus

Guru Nanak Dev University and another ..Respondents CORAM: Hon'ble Mr. Justice Rakesh Kumar Jain

Present:

Mr. Veneet Sharma, Advocate, for the petitioner.

***** Rakesh Kumar Jain, J. (Oral) The petitioner is a student of the LL.B. 5 Years Integrated Course. He got re-appear in one subject of Sociology in 5th semester, one subject of Law of Contract in 6th semester and one subject of Transfer of Property Act in 8th semester. It is alleged that re-appear examination of the even semesters are starting from 05.05.2017 and the examination of the petitioner are commencing from 09.05.2017. It is further averred that as per the Rule of the University, re-appear examination of the even semesters shall take place with the examination of the even semester. It is further submitted that the University has refused to issue roll number to the petitioner on the ground that he had already exhausted the number of chances for appearing in the re-appear examinations of the 5th semester, therefore, she is not eligible to continue with the course. Counsel for the petitioner has submitted that a period of maximum 7 years is provided to complete the course and has referred to

CWP No.9689 of 2017 [ 2 ] ***** certain interim orders passed by this Court by which the petitioner(s) therein were allowed to take the re-appear examination as an interim measure. It is submitted that till the decision of the said writ petition(s), the petitioner may be permitted to appear in the re-appear examination. After hearing learned counsel for the parties and examining the available record, I am of the considered opinion that now the petitioner cannot take advantage of the orders passed by this Court in other cases. There is no dispute that the petitioner has already exhausted all the special chances available to her in terms of Clause 6 of the Ordinance pertaining to Bachelor of Laws contained in the University Calendar. Therefore, the case of the petitioner is squarely covered by the decision of this Court rendered in the case of Priansh Abrol vs. Guru Nanak Dev University and others, CWP No.8088 of 2017, decided on 04.05.2017.

Consequently, the present writ petition is hereby dismissed being denuded of any merit.
