RSA No.2068 of 2011(O&M) [2] Present Regular Second Appeal has been preferred by the defendant-appellant feeling aggrieved against the concurrent finding of facts recorded by both the learned courts below, allowing the suit for possession filed by the respondents-plaintiffs.

Present application has been filed by the appellant for withdrawal of the main appeal on account of the settlement which has been arrived at between the parties.
