SURYA KANT, J.(ORAL) Land of the petitioners was acquired for setting up 'New Grain Market' at Gharaunda, District Karnal. The grievance appears to be that their claim for allotment of plots under the 'Oustees Category' does not presently fall within the ambit of any policy of the State Government or of the Marketing Board. The petitioners, thus, seek a direction to the State Government to revisit the existing policy and take an appropriate decision so as to make them eligible for allotment of plots under the 'Oustees Category'. [2] We have heard learned counsel for the parties and gone through the record.
[3] As the facts would speak for themselves, the petitioners are essentially seeking a direction to the State to formulate a policy in their favour. While such a direction may not fall within the ambit of powers exercisable under Article 226 of the Constitution, it appears expedient to Meenu 2018.07.31 10:19 I attest to the accuracy and authenticity of this document chandigarh
CWP-7051-2018 -2observe that since the State Government and its Agencies have in the past taken various policy decisions to rehabilitate the expropriated owners, let them sympathetically consider the request of the petitioners and take an decision as to whether or not they too can be included in the category of 'Oustees'. It shall be appreciated if an appropriate decision is taken within a period of four months from the date of receipt of a certified copy of this order.
