As per the reply filed by the respondents, payment was made in terms of the order passed by this Court in CWP-4833-2016, which petition was disposed of in terms of CWP-25747-2015, according to which, there was no direction to pay interest on the delayed release of the arrears hence, the interest has not paid to the petitioner.

  I have heard learned counsel for the parties and have gone through the record with their able assistance. Once, the payment of Rs.11,75,967/- has been made to the petitioner under the orders of this Court and it is a conceded position that there was no order for the grant of interest despite a claim raised, the petitioner cannot claim interest unless and until the order passed in CWP4833-2016 is modified in any manner. Faced with this situation, learned counsel for the petitioner submits that the present petition may kindly be disposed of having been not pressed any further with liberty to file a review petition in CWP-4833-2016 so as to claim interest on delayed payment.

Ordered accordingly.
