(ORAL) This is a petition that has been filed for grant of regular to the petitioner in FIR No.0010 dated 22.01.2019 registered under Sections 304B and 34 IPC at Police Station GRP Jalandhar, District Jalandhar. Learned counsel for the petitioner would argue that the matter has already been compromised between the parties as would be reflected by the affidavit given by the complainant. It is submitted that no useful purpose would be served in retaining the petitioner in custody since the challan has been presented and the charges stands framed. At this stage, Mr. Mohit Rathi, Advocate has put in appearance on behalf of the complainant and submits that the complainant has no objection in case the petitioner herein is allowed regular bail. I have heard counsel for the parties and have perused the paper book.

CRM-M No.44 of 2021 (O&M) -2In view of the fact that the a compromise has arrived at between the parties and the complainant has no objection in case the petitioner is allowed regular bail, the instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
