Dated Police Station Sections 02.06.2022 Old Faridabad, 406, 420 & 120-B IPC Distt. Faridabad 1.The petitioner apprehending arrest in the FIR captioned above, had come up before this Court under Section 438 CrPC seeking anticipatory bail. 2.

Learned counsel for the petitioner submits that the total money attributed to the petitioner along with co-accused is Rs.2,60,000/-, which is disputed by him. However, even if half of that amount is attributed to the petitioner, it comes to Rs.1,30,000/- which he is willing to deposit with the concerned police station/IO on or before 13.10.2022. He further submits that the co-accused/Shiv Raj has already been granted bail by this Court vide order dated 18.07.2022 passed in CRM-M-29006-2022 and the same is made absolute vide order dated 29.08.2022. 3.

Given the statement made by learned counsel for the petitioner, interim bail may be granted to the petitioner subject to his depositing the aforesaid amount. 4.

At this stage, learned counsel for the complainant has strongly opposed the grant of anticipatory bail to the petitioner and submits that apart from this, there are serious allegations against the petitioner.

In the event of arrest, the petitioner shall be released on interim bail, on furnishing of his personal bonds/surety bonds to the satisfaction of the concerned investigator/arresting officer. Petitioner is directed to join investigation within seven working days from today and deposit the aforesaid amount to the concerned police station/IO on or before 31.10.2022.

It is clarified that if the petitioner does not join investigation, as aforesaid, the interim anticipatory bail shall be vacated on this ground alone. It is also clarified that if the petitioner fails to deposit the aforesaid amount, complainant is at liberty to file application for cancellation of bail.
