RFA No.3869 of 2019 (O&M) It has been averred that it is the applicant-appellant who is actually the beneficiary of the acquired land which was handed over to the applicant-appellant by the Government after acquisition and the appellant has made the payment of compensation to the landowners, therefore, the applicant is the necessary party and has a right to file the instant appeal.

Accordingly, in view of the averments made, duly supported by the affidavit of Chief Executive Officer of the applicant-appellant Shrine Board, the application is allowed and the applicant-appellant is permitted to file the instant appeal as appellant.
