Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to re-fix the pension of the petitioners by granting them an annual increment for the service rendered by them in their last year of service i.e. retiring year as they have completed requisite 6 months or more than 6 months of service as required under the Haryana Civil Services (Revised Pay) Rules, 2008, with all consequential benefits of arrears etc. along with interest @ 18% per annum till the date of actual payment. Further prayer has been made to direct the respondents to decide the representation-cum-legal notice dated 21.07.2024 (Annexure P-12).

Learned counsel for the petitioners, at the very outset, confines his prayer for deciding representation-cum-legal notice dated 21.07.2024 (Annexure P-12). Mr. Saurabh Mohunta, DAG, Haryana, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.5 to decide representation-cum-legal notice dated 21.07.2024 (Annexure P-12), submitted by the petitioners expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
