The petitioner is seeking quashing of order dated 07.05.2025 (Annexure P-2) as well as order dated 02.06.2025 (Annexure P-5) passed by learned Judicial Magistrate Ist Class, Gurugram in NACT No.80950 of 2023, filed on 30.05.2023 titled as "7MED India Private Limited Vs. Anoop Singh and Anr." filed under Section 138 of Negotiable Instruments Act, 1881 by the complainant/ respondent whereby exemption application dated 07.05.2025 of the petitioner has been dismissed and warrants of arrest have been issued; and further proclamation proceedings under Section 82 Cr.P.C. were initiated against the petitioner to secure his presence. 2.
Learned counsel for the petitioner contends that on 07.05.2025, the petitioner was suffering from high grade fever and filed an application for exemption from personal appearance through his counsel but the said application was declined and warrants of arrest were issued against the present petitioner for 02.06.2025. However, on 02.06.2025, the identifier of the petitioner was present in Court with his affidavit to the effect that the petitioner has suffered a major Sonia Puri 2025.07.22 09:39 I attest to the accuracy and integrity of this document
CRM-M No.37330 of 2025 -2- urinary tract problem and a catheter has been inserted in his body, the Court initiated proceedings under Section 82 of Cr.P.C. and accordingly, proclamation was issued against the petitioner under Section 82(2)(i)(b) Cr.P.C. for 22.09.2025. Learned counsel for the petitioner, on instructions, further submits that the petitioner undertakes to appear before the trial Court on each and every date and shall not seek any exemption for his personal appearance on any date of hearing. Hence, in the aforementioned facts and circumstances, the petitioner prays that directions be issued to the Trial Court that his bail application, which he would be filing on his surrender, be decided. 3.
Keeping in view the facts of the case, the service of respondent is dispensed with as it will delay the proceedings. 4.
I have heard learned counsel for the petitioners and perused the material placed on record.

No legitimate ground to interfere in the impugned order dated 07.05.2025 and 02.06.2025 is made out and the present petition is hereby, dismissed. 6.
However, in case the petitioner surrenders before the trial Court within 07 days from today at 10:00 A.M and moves an application for grant of regular bail, on his doing so, the trial Court shall consider and decide the same on the same day.
