The petitioner is a Contractor who is praying for release of his balance payment with interest.

It is submitted that the petitioner was given the tender and an agreement dated 11.03.2015 was executed, in which it is provided in Clause 5 that any dispute arising between the parties would be referred to the Managing Director of the HAFED or his nominee.

Counsel for the petitioner has prayed that this petition may be disposed of with liberty to move an appropriate application to the concerned authority, who may be directed to decide the same as early as possible. In view thereof, the present petition is hereby disposed of with liberty to the petitioner to approach the appropriate authority in terms of the provisions of the contract. In case any such application is filed by the petitioner to the appropriate authority within a period of two weeks from today, the appropriate authority shall decide the same within a further period of two weeks after following the principle of natural justice.
