* * * * S.J. VAZIFDAR, A.C.J. (ORAL) By consent, the impugned order dated 14.01.2014 dismissing the arbitration petition under Section 34 of the Arbitration Act for default is set aside.

The learned Trial Court Judge shall decide the appellant's objections as expeditiously as possible according to the matter priority as on the date on which the application for execution was filed with liberty to apply to the Court to expedite the matter.

In the meantime, the stay granted qua the execution proceedings shall continue. The appellant shall within two weeks file an affidavit disclosing his assets - movable and immovable and the appellant shall not dispose of, alienate, encumber, part with possession of and/or create any third party rights in respect of his movable and immovable properties, if any, without the leave of the trial Court till the application is decided. 4.

Disposed of.
