SUVIR SEHGAL, J. (Oral) The petitioner is seeking regular bail in FIR No.78 dated 02.12.2008 under Sections 489-A, 489-B, 489-C, 489-D and 120-B of Indian Penal Code, 1860 registered at Police Station Cantt., District Bathinda.
Learned counsel for the petitioner has submitted that the petitioner is 62 years old and is in custody since 30.03.2019. He has further argued that co-accused Kuldeep Singh and Darshan Singh have been acquitted by the Additional Sessions Judge (Fast Track Court), Bathinda, vide order dated 22.02.2013 (Annexure P-2). Still further, it is submitted that the petitioner was not even named in the FIR. On instructions from ASI Balwinder Singh, learned State counsel has submitted that out of total 13 prosecution witnesses, 12 witnesses, have been examined.

Since the petitioner is in custody for the last 09 months and 20 days approximately and the trial will take sometime to conclude, no useful purpose would be served by keeping the petitioner behind the bars any further.
Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
