Present petition under Article 226/227 of the Constitution of India for issuance of directions to the respondents for taking into consideration the service rendered by the petitioner as S.P.O. for the purpose of grant of seniority, fixation of pay and other consequential benefits and release the arrears of pay as a request of grant of seniority and refixation of pay w.e.f. 27.09.1993.

Learned counsel for the petitioner contended that case of the petitioner is identical to case titled as Satwinder Singh and Others v. State of Punjab and Others (CWP-8549-2018, decided on 05.04.2018). The said petition has been allowed in terms of order (Annexure P3) passed in case Constable Rajinder Kumar v. State of Punjab and Others [CR-2295-2010 (O&M), decided on 06.09.2010]. Learned counsel submits that he would be satisfied if similar directions be also issued in this petition, as detailed in Deepak Kumar Bhardwaj 2018.05.15 15:02 I attest to the accuracy and integrity of this document

Civil Writ Petition No. 7316 of 2018 Annexure P3.

In view of above, without expressing any opinion on merits of the case, present petition is disposed of with directions to the respondents to consider and decide claim of the petitioner in the light of order (Annexure P3) within a period of six weeks from the date of receipt of a certified copy of this order. In case, on consideration, the competent authority reaches to the conclusion that the benefit claimed by the petitioner is admissible to him, in such eventuality, the consequential relief be allowed to him within a period of six weeks thereafter. However, in case the competent authority feels that the relief claimed by the petitioner is not admissible to him or made out, in that case, speaking order be passed in the matter.
