Mr. D.S.Patwalia, Senior Advocate, with Mr. Bikramjit Singh Patwalia, Advocate, for the petitioner(s). ***** Rakesh Kumar Jain, J. (Oral) This order shall dispose of two petitions bearing CWP-COM Nos.112 and 113 of 2017 in which similar show cause notice has been challenged by the petitioner(s).

Counsel for the petitioner(s) has submitted that the respondents have though allowed to the petitioner(s) to file reply to the show cause notice within 14 days but in the last paragraph of the said show cause notice, they have asked the petitioner(s) to pay the amount. Therefore, they have approached this Court treating the show cause notice an order of recovery. After hearing learned counsel for the petitioner(s) and examining

CWP-COM Nos.112 & 113 of 2017 [ 2 ] ***** the available record, I am of the considered opinion that the impugned order/notice has to be treated as a show cause notice. The petitioner(s) shall be entitled to file reply to the said show cause notice within a period of 14 days from today, as prescribed.

Consequently, both the petitions are hereby disposed of, giving liberty to the petitioner(s) to file reply to the show cause notice(s) much less the impugned order within a period of 14 days from today. Thereafter, the respondents may decide the issue, in accordance with law. A photocopy of this order be placed on the file of another connected case.
