***** RAJAN GUPTA , J. (Oral) Petitioners have impugned the order dated 17.01.2018 passed by respondent No.2-Sub Divisional Magistrate, Barnala, whereby he has rejected the plea of the petitioners seeking eviction of respondent No.3. It has also been observed therein that the Special court did not have any jurisdiction to entertain the application. Only apprehension is that the findings recorded by the Sub Divisional Magistrate, Barnala, would stand in the way.

Learned State counsel does not controvert the plea that Sub Divisional Magistrate did not have the jurisdiction to entertain the petition as learned counsel are ad idem on the question of lack of jurisdiction. Impugned order is hereby set aside. Petitioners are at liberty to approach the appropriate authority for redressal of their grievance. Petition is hereby disposed of.
