The present petition has been filed under Section 482 Cr.P.C. for issuance of direction to respondents No. 2 and 3 to properly investigate in a fair and just manner in FIR No. 32 dated 24.02.2022 under Sections 323, 324, 506, 148, 149 IPC registered at Police Station Sadar Ludhiana, District Ludhiana.
Notice served upon the official respondents No. 1 to 4 through the State's counsel.
Learned counsel for the petitioner submits that he would be satisfied in case directions be issued to respondent No. 3 to decide the representation dated 18.07.2022 (Annexure P-5) within the time bound manner.
The prayer being innocuous is not opposed by the learned State counsel. Given above, respondent No. 3-Joint Police Commissioner, Ludhiana shall within 10 days from today take a decision on whether the representation shall be decided by him or he shall delegate it any other officer of IPS Cadre. Once such decision is made, the concerned officer shall decide the representation within 45 days from the receipt of same by passing a speaking and reasoned order.
In case, the grievance of the petitioner still exists, she shall be at liberty to avail legal remedy in accordance with law including approaching this Court. The decision so made be communicated to the representationist at the earliest by investigator.
Petition is allowed to the extent above. All pending applications, if any, stand disposed of.
