***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Mandamus directing respondents to conduct verification of the documents of the petitioner, who has been issued appointment letter for the post of Staff Nurse pursuant to advertisement dated 07.09.2019 (Annexure P-2). Further a direction has been sought to allow the petitioner to join on the post of Staff Nurse pursuant to appointment letter dated 10.07.2022 (Annexure P-4) after conducting verification of her documents.

Qua her grievance, petitioner has also submitted a representation dated 20.07.2022 (Annexure P-5), but the same has not been adverted by respondents till date. Hence the petition.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the pending representation dated 20.07.2022 (Annexure P-5) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending representation, as suggested by learned State counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the pending representation dated 20.07.2022 (Annexure P-5) of the petitioner and pass an administrative order, in accordance with law. Till the decision is taken on the pending representation, post in question for which appointment letter was issued to the petitioner shall not be offered to another candidate to avoid any third party rights.

Let the needful be within 6 weeks from today. 8.

Disposed of accordingly.
