(ORAL) Learned counsel for petitioners seeks liberty of this Court to withdraw present writ petition qua petitioner Nos.1 and 3, with liberty to file fresh one on the same cause of action, as the matter regarding game event played proving the validity of 1993 Policy, is pending consideration before 1st Division Bench of this Court.

Ordered accordingly.

Via-a-viz petitioner No.2, he submits that petitioner had participated in Haryana State School Championship in game/event 'Kabaddi' and obtained 3rd position. Her case is covered under Policy of May 2018 (Annexure P-17) against Sr. No.13, therefore, would be entitled to Sports Gradation Certificate (Grade D) and in this regard, had already submitted representation dated 09.03.2019 (Annexure P-10), as she, in pursuance to advertisement dated 25.08.2018 inviting the applications for filling up Group D posts, has been selected and offer of appointment has been given, but owing to non-production of Sport Gradation Certificate, the

On asking of the Court, Mr. R.K. Doon, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondent(s)/State. Counsel for the petitioners is directed to supply the requisite copy of paper book, if not supplied.

I am of the view that grievance of petitioner No.2 cannot be left in lurch, as on consideration of her candidature, she was found fit for appointment as Animal Attendant (Group D), in the office of Animal Husbandry and Dairying, District Kaithal. Respondent No.6/District Sports and Youth Affairs Officer, Jind, is directed to consider representation dated 09.03.2019 (Annexure P-10), for issuance of Sports Gradation Certificate, in view of policy in vogue, at the time of issuance of advertisement i.e. 25.05.2018, enabling petitioner No.2 to fulfil requisite requirement as being sought by the Department and to join her services. Let this exercise be done within a period of two weeks from the date of receipt of certified copy of this order and in case, petitioner No.2 is found eligible for issuance of Sports Gradation Certificate in terms of Policy dated 25.05.2018, she shall be allowed to join her services within one week thereafter.

Till then, candidature of petitioner No.2, shall not be cancelled. Disposed of.
