The present civil writ petition is disposed of with a direction that the revisionist defendant would file the written statement in the main suit within 10 days from today and thereafter, the trial Court after hearing learned counsel for the parties would dispose of the application under Order 39 Rules 1 and 2 CPC and application under Order 39 Rule 4 CPC, on merits within 10 days thereafter. For that purpose, the trial Court may pre-pone the date of hearing in the main case, if need be. It is expected that the trial court would dispose of the applications strictly on merits without being influenced by any other factor.
