The petitioner - Amanpreet Singh has filed petition under Section 483 of BNSS for grant of regular bail in Crime No.27 of 2023 dated 15.12.2023, under Sections 8, 18, 23 & 29 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station NCB, CZU, Chandigarh.

As per the facts of case, on 15.12.2023 from the consignment bearing No.AWB5958496703 destined to USA, opium weighing 0.102 Kg. was recovered concealed in an electronic device. Identity of present petitioner was established from CCTV footage. With these allegations, present complaint was filed which is Annexure P-6. 3.

Learned counsel for petitioner pointed out that allegations are false. Present petitioner was arrested and he is behind the bars since 09.06.2024. Trial is pending before learned Special Court, Ludhiana. The alleged recovery falls in non-commercial quantity. Bail petition is opposed by learned counsel representing respondent.

I have considered the aforesaid facts. It cannot be ignored that alleged recovery falls in non-commercial quantity. Trial of this case is likely to take some time. Therefore, without expressing my mind on the merits of case, regular bail petition filed by petitioner - Amanpreet Singh is allowed.
