The petitioner incarcerated in the FIR captioned above has come up before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking regular bail.

After arguing for some time, counsel for the petitioner wishes to withdraw the present petition with the following liberties: a. to file fresh after citing judicial precedents of Hon'ble Supreme Court where the Hon'ble Supreme Court has granted bail with similar quantity and similar custody to that of petitioner; b. to file fresh after completion of one year of custody. 3.
Given above, the present petition is disposed of as withdrawn with the liberty aforesaid. It is clarified that if the trial is not concluded within one year of petitioner's custody, petitioner is permitted to file fresh petition for bail and the period for which the trial is delayed due to the petitioner shall not be counted in the period of one year of custody.
