Present petition has been filed by the petitioner, seeking grant of anticipatory bail, in case, FIR No.59, dated 17.02.2025, under Sections 316(2), 318(4) of BNS and 10, 24 of Immigration Act, registered at Police Station Asauda, District Jhajjar. 2.
Complainant - Deepak Ruhil got registered the FIR, which reads as under:- "Sir, the request is that I am Deepak Ruhil son of Shri Late Ramkaran Ruhil resident of village Rohad, District Jhajjar, I came to know that Ravi alias Monty resident of village Basana works in sending people abroad, I met Ravi alias Monty on 15 October 2024 and I told him that I want to go to America, then Ravi alias Monty said that this is our work, I asked him how much money it will cost, he told me that it will cost you Rs 53,00,000 in which you will have the entire contract to settle in America, I gave my documents to Ravi alias Monty and he told me that your visa will come and you will reach Spain by
boarding a flight, after that half payment will have to be made after reaching Spain and half payment will have to be made after reaching Teejwana. After that I got a call from Ravi alias Monty that your visa of Malta has been approved and you will have to pay 20,00,000 rupees. When I told Ravi alias Monty that you will take the payment after reaching Spain, he said that this is a paid visa, its payment has to be made through hawala only then you will get your passport, so I withdrew 20,00,000 rupees from my mother Savitri Devi's account which came after selling the plot and gave it in cash on 04.12.2024. I gave him this money at my friend's salon located on Mandothi Road in my village, whose video recording is also available with me. On 19.12.
2024, Ravi alias Monty got my passport handed over to a boy from my village who lives in Rohtak, named Amit son of Naresh, and told him that I have a flight from Delhi to Dubai at 4:30 pm. And he had earlier sent me the number of a person named Abhi and said that now he will guide you. I left at 3:00 pm with 1000 URI worth Rs. 3,54,000/-and 3000 US Dollars from my own money, which Ravi alias Monty had said that he will adjust in the account later. On 19.12.24 at 4:30 pm, 1 boarded an Air India flight from Delhi Airport to Dubai and reached Dubai at around 8 pm. There, a person named Abhi sent me a ticket to Istanbul and told me to stay at the same airport and I boarded a flight to Istanbul on 20.12.24 at 3.
00 am and upon reaching Istanbul, Ravi alias Monty and his agent sent me a ticket to Madrid Spain and after staying at the airport for a few hours, I boarded a flight to Madrid Spain and on 20.12.24 at 3:00-4:00 pm, I reached the hostel named Motion chueca mentioned by Ravi alias Monty in Madrid Spain. I stayed there from 20-21-22-23-24.12.24. And then he sent me a ticket to El Selvador and I boarded a flight from Madrid Spain to El Selvador on 25.12.2024 in the morning and reached El Selvador Airport around 7:00-8:00 in the evening, there I gave 800 US dollars to Immigration and came out of the airport and after that I called Ravi @ Monty, then his agent sent me the booking of Hotel Nova and I took a taxi and reached the hotel. The next day on 26.12.
2024 I got a call that I am the donker of Ravi alias Monty, come and sit in the Nissan car outside the hotel, then he showed me my photo and I sat in the car as per the instructions of Ravi alias Monty, then that donker took me to a deserted place Guaxmala and after that I went to Mexico on 29.12.2024 and after that on 29.01.
USA police caught me and put me in the camp, on date 14.02.2025 the US Army put me on a plane and sent me to Amritsar airport, Punjab, India, on 16.02.2025 1 reached Amritsar airport Punjab *India, I called Ravi alias Monty resident of village Basana, Rohtak here in India, then agent Monty said that I do not know you and disconnected the phone, so you are requested to take action against Ravi alias Monty resident Basana for fraud. Strict legal action should be taken in this regard and my Rs. 53,54,300/- should be returned. SD- Deepak Applicant Deepak Ruhil S/o Ramkaran Ruhil Village Rohad, Tehsil Bahadurgarh, District Jhajjar, 124507 8569901137, 9034706197." 3.
After hearing the submissions addressed by counsel for the petitioner, on 17.07.2025, following order was passed:- "2.
On oral request of learned counsel for the petitioner, complainant - Deepak Ruhil, son of late Sh. Ramkaran Ruhil, resident of Village Rohad, District Jhajjar, is hereby ordered to be impleaded as respondent No.2 in the array of respondents. Let an amended memo of parties be filed in the Registry within a period of two days from today.

Learned counsel for the petitioner submits that except for the allegation of having paid an amount of Rs.22,00,000/- to the petitioner, there is no other substantive material in the FIR to prima facie prove the allegations. Thus, learned counsel prays for the grant of concession of anticipatory bail to the petitioner.
Notice of motion for 25.07.2025.

On advance notice, learned State counsel puts in appearance on behalf of respondent No.1 - State, and seeks some time to respond to the submissions addressed by learned counsel opposite, after seeking instructions. And, in case of necessity, to file status report by verifying the submissions addressed by the petitioner's counsel.

Newly added respondent No.2 be served through the Station House Officer (SHO) of the police station concerned, within whose jurisdiction he is residing, with due intimation regarding the next date fixed before this Court. Response, if any, be filed a week before the adjourned date of hearing with an advance copy to the counsel opposite.

In the meanwhile, learned counsel for the petitioner shall obtain necessary instructions as to
whether the petitioner is willing to compensate the complainant or not."
Vide order dated 03.09.2025, counsel for respondent No.2/complainant was directed to explain as to how and in what manner the said amount was arranged by him for paying it to the accused persons.

In compliance to the order dated 03.09.2025 passed by this Court, the amount arranged by respondent No.2, as reflected in the reply filed on his behalf, reads as under:- "i.
The mother of the complainant namely Savitri sold her plot to one Ajay son of Dharambir Ruhil in total sale consideration of Rs. 46,20,000/-, out of which amount of Rs. 27,39,000/- received through cheques in the mother of the complainant and amount of Rs. 18,81,000/- was received in cash. For ready reference, copy of agreement to sell dated 11.11.2024 along with statement of Savitri is attached as Annexure R-2/1.

That amount of Rs. 4 Lacs was transferred by the complainant in the account of his friend namely Mohit and thereafter, complainant received the amount in cash and given to the accused. For ready reference, copy of transaction details reference ID 433910926331 dated 04.12.2024 is attached as Annexure R-2/2.
iii.
That on 04.12.2024, amount to Rs. 20 Lacs given to agent Ravi in cash.
iv.
That on 30.12.2024, amount of Rs. 30 Lacs given to agent Ravi by the brother of the complainant namely Naveen in cash when the complainant was in Cancun, Mexico.
v.
That on 03.01.2025, when the agent Ravi asked to deposit Rs. 10,000/- lying short of earlier amount of Rs. 30 Lacs, therefore, amount of Rs. 10,000/- transferred through Phone-pay to agent Ravi by the friend of the complainant namely Mohit. For ready reference, Screen Shot of Transaction detail of Rs. 10,000/- dated 03.01.2025 is annexed as Annexure R2/3.

That when complainant leave the country, he has purchased One Thousand Euro currency and One Thousand US Dollar calculating as amount of Rs.3,54,300/-.
Therefore, in view of the above, total amount as received by the petitioner is calculated as Rs. 53,54,300/-and as per the version of FIR, the complainant alleged that the petitioner cheated him for sending abroad and usurp hard earned money of Rs. 53,54,300/-.
That complainant seeks kind indulgence of this Hon'ble Court that the anticipatory bail filed by the petitioner may kindly be dismissed as the custodial interrogation is very much required to recover the aforesaid amount."

It is noticed that amount described in the FIR is found to be in consonance with the details mentioned in the reply filed on behalf of respondent No. 2.

In view of the above, this Court views that no case for grant of anticipatory bail to the petitioner is made out. Accordingly, present petition stands dismissed.

While parting with the order, it is observed that FIR in the present case was registered on 17.02.2025, and present petition for anticipatory bail is pending before this Court without any interim protection to the petitioner.
It is a matter of concern that the concerned Investigating Officer has not made adequate efforts to secure the joining of the petitioner in the investigation in accordance with law. Furthermore, nothing has been placed on record to indicate as to when any attempt was made to arrest the petitioner, in accordance with due process.
More than one year has elapsed since the registration of the FIR. Accordingly, it is directed that conduct of the Investigating Officer be examined by the Superintendent of Police, Jhajjar, and appropriate action be taken against the said officer, if found guilty of dereliction of duty or negligence in the discharge of official functions. 9.
With the observations recorded here above, present petition stands disposed of.
