The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing DDR No.27 dated 22.05.2021 registered under Sections 307, 323, 324, 148, 149 IPC and Sections 25/27/54/59 of Arms Act (Section 201 IPC/238 of BNS added later on) in case FIR No.58 dated 17.05.2021 registered under Sections 307, 323, 324, 148, 149 IPC (Sections 302, 3(1) of SC/ST added later on vide G.D. No.06 dated 19.05.2021) and Sections 25/27/54/59 of Arms Act at Police Station Sadar Patti, Tarn Taran.

The learned counsel for the petitioner contends that it is a case of version and cross-version. From the side of the petitioner, Dhara Singh has been murdered and Salwinder Singh and Kulwinder Singh have been injured. An FIR No. 58 dated 17.05.2021 U/s 307, 323, 324, 148, 149 IPC and
CRM-M-37250-2025 -2Sections 25/27 of Arms Act (Section 302 IPC added later on) P.S. Sadar Patti, District Tarn Taran stands registered against the present complainant party. The petitioner himself has received gunshot injuries in the occurrence. As he is in custody since 07.03.2025 but none of the 36 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

A short reply dated 21.11.2025 by way of an affidavit of Lovkesh, PPS, Deputy Superintendent of Police, Sub Division Patti, District Tarn Taran has been filed on behalf of the State by the learned counsel for the State. The same is taken on record. He concedes that initially, an FIR No. 58 dated 17.05.2021 U/s 307, 323, 324, 148, 149 IPC and Sections 25/27 of Arms Act (Section 302 IPC added later on) P.S. Sadar Patti, District Tarn Taran came to be registered against the complainant party for the murder of Dhara Singh. The present cross-version was registered as DDR No.27 dated 22.05.2021 under Sections 307/323/324/148/149 of IPC and Sections 25/27/54/59 of Arms Act (Section 201 of IPC and Section 238 of BNS added later on). He also concedes that the petitioner has himself received gun-shot injuries, that he is in custody since 07.03.2024 and that none of the 36 prosecution witnesses has been examined so far. 4.
I have heard the learned counsel for the parties. 5.
Admittedly, it is a case of version and cross-version. It would be a moot point during the course of the trial as to which party is the aggressor
CRM-M-37250-2025 -3side. The petitioner is stated to be in custody since 07.03.2025 but none of the 36 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 6.
Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Suraj Singh S/o Lakhwant Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.
The petition stands disposed of.
