Mr. Rajesh Goyal, Advocate for Mr. Pritam Saini, Advocate, for the landowners. Mr. Nilesh Bhardwaj, Deputy Advocate General, Punjab. RAJESH BINDAL, J By filing this appeal, the landowners are seeking enhancement of compensation for the acquired land.
Briefly the facts are that vide notification dated 11.11.1993 issued under Section 4 of the Act, the State of Punjab sought to acquire land situated within the revenue estate of villages Sohna and Lakhnaur, Tehsil Kharar, District Ropar, for industrial purpose. The Land Acquisition Collector (for short, 'the Collector'), assessed the market value of the acquired land @ ` 1,75,000/- per acre for all kinds of land. Dissatisfied with the award of the Collector, the landowners filed objections. On reference under Section 18 of the Act, the learned court below vide order dated 21.10.2004, determined the market value of the acquired land @ ` 6,96,000/- per acre. The award of the learned court below has been impugned in the present appeal.
Learned counsel for the landowners submitted that the claim made in the present appeal is squarely covered by the judgment of this Court passed in RFA No.627 of 2001-Balwant Singh v. The State of Punjab, decided on 6.2.2008, whereby compensation for the acquired land was assessed @ ` 8,00,000/- per acre.
