The present petition has been filed for setting aside the letter dated 12.06.2019 (Annexure P-9) and all other illegal orders/actions of the Municipal Council, Shri Anandpur Sahib - respondent No.2, for removal of shops of the petitioners without jurisdiction and without providing any opportunity of hearing. Further prayer has been made for directing respondents No. 2 and 3, not to take any illegal and coercive steps for the removal of shops of the petitioners, without following due process of law. Learned counsel for respondent No.2 submits that the land belongs to Gurdwara and there is no provision for allotment of the land to the petitioners. However, if the petitioners file a representation, raising their grievances before respondent no.2, then the same will be considered and decided as per law by the Executive Officer, Municipal Council, Shri Anandpur Sahib.

Learned counsel for the petitioners has submitted that the petitioners may be allowed to file representation before respondent no.2 and the respondent No.2 may be directed to decide the same in a time bound manner.

In view of the above submissions made by learned counsel for the parties, the present petition is disposed of with liberty to the petitioners to file their representation before respondent No.2, within a period of 2 weeks from from the date of the receipt of certified copy of this order and in case they do so, then respondent No.2 i.e. Executive Officer, Municipal Council, Shri Anandpur Sahib, is directed to decide the same as per law, within a period of 4 weeks from the date of filing of the same in its office.
