(ORAL) ase heard via Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.161, dated 17.09.2020, having been registered at Police Station Radaur, District Yamuna Nagar, alleging therein the commission of offences punishable under Sections 148, 149 and 506 of the IPC (with Sections 325, 307 of the IPC as also Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, added later).
Learned counsel for the petitioner submits that though the petitioner has been in custody only for about 61⁄2 months, however there is no specific role attributed to him in the FIR and that even the co-accused to whom specific roles DINESH 2022.01.09 19:31 I attest to the accuracy and integrity of this document
CRM-M-49288 of 2021 -2were attributed, i.e. Mohit and Gulab Singh, have already been admitted to bail by this court and the trail court respectively.
Having considered the matter, though those persons seem to have been admitted to bail essentially on the ground of long custody, and as regards coaccused Mohit because the prosecution witnesses were not turning up to testify despite a number of opportunities given, in the aforesaid circumstances,
the petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial court.
