Prayer made in the present petition is for quashing of order dated 06.08.2010, by which the compassionate assistance had been denied to the petitioner as per Rule 3(d) (II) of the Haryana Compassionate Assistance to the Dependents of the Deceased Government Employees Rules, 2003, as per which the service rendered by the deceased employee has to be of 3 years, while in the policy dated 01.08.2006, Annexure P-3, it has been mentioned that the eligibility to receive financial assistance has to be as per the provisions of pension/family pension scheme, 1964, which provides for service to be that of 1 year.

Learned counsel, submits that since it is an admitted case as is apparent from para 1 of the preliminary submissions that the service rendered by the petitioner was 1 year and 6 months, her claim may be reconsidered in a time bound manner, keeping in view the aforesaid policy. 3.
Learned State counsel has no objection to the limited prayer made.

CWP-20101-2010 the case, this petition is hereby disposed of with a direction to the respondents to reconsider and decide the case of the petitioners, keeping in view the aforesaid policy, within a period of 03 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to them and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same shall contain reasons and the petitioners shall be free to seek legal redress thereupon.
