***** Sandeep Moudgil, J.(Oral) Instant writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of writ in the nature of Mandamus directing the respondents to exempt the petitioner from online transfer drive, which has been in process since 11.12.2024 as he is covered by clause 9(1)(a) of the online transfer policy dated 25.11.2021 (P-1). 2.

Short reply by way of an affidavit of Devender Dahiya, Engineerin-chief, Public Health Engineering Department, Haryana has been filed on behalf of respondents No.1 to 4 after notice of motion was issued by this Court vide order dated 15.07.2025. While referring to para 6 of the reply, learned State counsel submits that earlier the petitioner was not transferred as interim relief was granted by this Court and now the petitioner falls in protected category as there is less than 12 months in his retirement. 3.

It is a matter of record that the petitioner was not transferred under the Transfer Policy dated 25.11.2021 as well and now said Transfer SONIA BURA 2026.03.19 13:08 I attest to the accuracy and integrity of this document

CWP-19590-2025 -2- Policy has been replaced by the Government with Model Online Transfer Policy-2025.

Once the new Policy dated May, 2025 has come in place, the writ petition has become infructuous as no cause of action would survive under the Policy, which is not in existence particularly in the light of fact that petitioner was not transferred at all in that Policy.

Accordingly, present petition stands disposed of as having been rendered infructuous.
