JASWANT SINGH, J (ORAL) Instant appeal, at the hands of the appellant-Udai Veer Singh, calls into question of validity of the impugned judgment dated 04.1.2017 vide which his petition filed under Section 276 of the Indian Succession Act along with his two brothers for grant of probate in respect of Will dated 15.4.2013 executed by Dr. Brijanand Singh son of late Bahadur Singh, has been dismissed. Case has been called twice since morning but nobody has turned up for the appellant.

It is apparent that for the last two dates, none has been causing appearance for the appellant and the position is same today.
