NIDHI GUPTA, J. (ORAL) The petitioner has filed the present 1st petition under Section 438 Cr.P.C. seeking anticipatory bail in FIR No. 106 dated 30.07.2023 registered under Section 306 IPC at Police Station Shri Hargobindpur, Tehsil Batala, District Gurdaspur.
On 25.08.2023, this Court had passed the following order :- "Prayer in this petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner/husband of the deceased in case FIR No.106 dated 30.07.2023, under Section 306 IPC, registered at Police Station Shri Hargobindpur, Tehsil Batala, District Gurdaspur.
Notice of motion.
On asking of the Court, Mr. Kunwarbir Singh, AAG, Punjab accepts notice on behalf of respondent-State.
-2A complete set of paper book be supplied to the learned State counsel to file effective response. Learned State counsel seeks time to file the status report in the matter.
Adjourned to 16.10.2023.
The petitioner, in the meantime, is directed to join the investigation and cooperate in the same.
No coercive steps shall be taken against the petitioner till the next date of hearing."
Learned counsel for the petitioner submits that in compliance of the order dated 25.08.2023 passed by this Court, the petitioner has joined the investigation.
Status report dated 12.10.2023, filed by way of affidavit of Sh. Rajesh Kakkar, Deputy Superintendent of Police, Sub Division Sri Hargobindpur, Police District Batala, District Gurdaspur on behalf of respondent-State, is taken on record.
Learned counsel for the State, on instructions from ASI Avdesh Singh, states that in terms of the order passed by this Court, reproduced above, the petitioner has joined the investigation; and is co-operating with the investigating agency, and no further interrogation is required, at this stage.
In view of the above, the order dated 25.08.2023 granting interim bail to the petitioner is made absolute. In the event of his arrest, he shall be released on bail on furnishing bail bonds to the satisfaction of SHO/Investigating Agency.
However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join the
-3investigation and cooperate with the investigating agency in case he is required for the same in future as and when called upon to do so. In case at any given point of time hereinafter, it is felt by the investigating agency that the petitioner is required for the investigation but is not cooperating, they will be at liberty to approach this Court for passing appropriate orders.
The petition stands disposed of.
