(Oral) By way of two separate above-mentioned petitions, the petitioners named Ajay Kumar and Balwinder Singh @ Jodha seek the relief of regular bail in the criminal case arising out of the same FIR bearing No.140 dated 18.09.2021 registered at Police Station Verka, District Amritsar, under Sections 379-B, 411 read with Section 34 IPC.

-2Bereft of unnecessary details, the allegations, as levelled in the present case, are that on the receipt of a secret information regarding both the petitioners having been indulging in the snatching of mobile phones and the wallets, ASI Gurwinder Singh and the police officials accompanying him, held a "Naka" (put up barricades) at the disclosed place and they saw both the petitioners coming on the motorcycle and they were apprehended. One mobile phone was recovered during the personal search of petitionerAjay Kumar. During their interrogation, they disclosed that they had snatched a Purse from one girl and had kept the mobile phone and the cash amount of Rs.700/- found lying in the same and had thrown the said Purse and keys near the field. During investigation, the said articles were found to be belonging to one Sukhbir Kaur.

Separate replies have been filed in both the petitions on behalf of the respondent-State, by way of the affidavit of Assistant Commissioner of Police (East), Amritsar City and the same are taken on the relevant record.

I have heard learned counsel for the petitioners as well as learned State counsel in the instant petitions and have also perused the file thoroughly.

Learned counsel for both the petitioners contend that the petitioners are behind the bars since 18.09.2021 and they are also not involved in any other criminal case of the similar nature and the Challan has already been presented in the Court and in these circumstances, the petitioners deserve the relief as prayed for in these petitions.

-3Learned State counsel does not dispute the afore-referred factual position.

Keeping in view the above-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioners named Ajay Kumar and Balwinder Singh @ Jodha are ordered to be released on regular bail subject to their furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned.
