The petitioner through instant petition under Article 226 of Constitution of India is seeking directions to respondent No.3 to issue passport as he has already been acquitted in FIR No.135 dated 07.09.2013, under Section 302 of IPC registered at Police Station Kulgarhi. 2.

Learned counsel for the petitioner inter alia contends that the petitioner has been denied passport on the ground that the petitioner is involved in the abovesaid FIR. The petitioner has already been acquitted vide judgement dated 08.12.2014. An appeal bearing No.CRA-DB-2502015 is pending before this Court against the judgment of acquittal. Learned counsel for the petitioner inter alia contends that the case of the petitioner is not covered by either clause (e) or (f) of Section 6

(2) of Passport Act. The case of the petitioner is squarely covered by judgment dated 14.07.2023 passed by this Court in CWP No.27167 of 2018.

Ms. Monica Chawla, Advocate for the respondent does not dispute the fact that the case of the petitioner is squarely covered by aforesaid judgment of this Court.

The petition stands disposed of with a direction to the respondents to decide application of the petitioner in view of judgment dated 14.07.2023 passed by this Court in CWP No.27167 of 2018, within 08 weeks from today.
