By way of present petition, filed under Section 482 Cr.P.C., prayer has been made for directing respondent No. 2, i.e. Director General of Police, Haryana, to handover/transfer investigation of case FIR No. 0068, dated 02.05.2022, under Section 306/34 IPC, registered at Police Station GRP Faridabad, to an independent agency or outside District Faridabad.
Learned counsel for the petitioner submits that case of murder of the brother of present petitioner has been converted to a case of suicide. Learned counsel further submits that police has not taken the matter seriously, therefore, not even recovered CCTV footage of the railway station/platform where incident had taken place. On advance notice, Mr. Ashish Yadav, Additional Advocate General, Haryana, appears and informs that as per his instructions from PRASHANT KAPOOR 2022.09.27 19:06 I attest to the accuracy and authenticity of this order/judgment
CRM-M-44629-2022 SI Vishwas Singh, investigating agency has already prepared a cancellation report on 14.07.2022, and very soon, same is likely to be submitted before the concerned Court through proper channel. In view of statement made by learned State counsel, let investigating agency complete the proceedings of submitting cancellation report before the Court within four weeks from today. Upon filing of cancellation report, the Court would decide its fate expeditiously preferably within next four weeks, in accordance with law. Present petition stands disposed of in above terms.
