Jagvir Singh S/o Sh. Jayanti Parshad) as necessary party. Learned counsel for the applicant does not wish to press the instant application.

Main case Pursuant to order dated 04.04.2022 passed by this Court, an affidavit dated 02.05.2022 has been tendered in course of hearing, which is taken on record. Copy has been supplied to learned counsel for the petitioners. Learned State counsel submits that per para 5 of the abovesaid affidavit, petitioner No.1 has already completed 58 years of age and retired on attaining the age of superannuation in December2021, therefore he is not eligible for appointment to the post of Assistant Engineer at this stage being overage. Whereas, petitioner No.2 has been issued offer of appointment for the post of VANDANA 2022.05.03 21:40 I attest to the accuracy and integrity of this document

Assistant Engineer (Civil) vide memo No.1/32/2018-21E dated 29.04.2022. Copy of offer of appointment is annexed as Annexure R-4. In view of the aforesaid, claim of petitioner No.2 qua promotion has been accorded on the administrative side and to that extent writ petition is rendered infructuous. Qua their other grievances, petitioners are at liberty to approach the competent authority, who shall look into the same, in accordance with law. Disposed of.
