(Oral) Prayer in the present petition filed under Section 439 of the Code of Criminal Procedure, 1973 is for grant of regular bail to the petitioner in case FIR No.208 dated 11.04.2018 under Sections 363, 366-A IPC and Section 4 of the POCSO Act registered at Police Station Quilla Panipat, District Panipat.

Criminal Misc. No. M-38404 of 2019 -2Learned State counsel, on instructions from HC Jaipal, does not dispute the fact that all the prosecution witnesses have been declared hostile in the case.
I have heard learned counsel for the parties. Considering the fact that the petitioner is in custody since 17.04.2018 and the prosecutrix herself has turned hostile and as on date, there is nobody to support the case of the prosecution against the petitioner, so as to establish his culpability, I deem it appropriate to release him on regular bail.
Accordingly, the present petition is allowed and the petitioner is admitted on regular bail, subject to furnishing of his bail bonds/surety bonds to the satisfaction of trial Court.
