(Oral) The aforementioned three petitions are being decided together as common questions of law on similar facts arise for adjudication therein. The grievance raised by the petitioners is that they have been offered appointments
-2in Mewat cadre, ignoring their merit and preference(s) for Rest of Haryana cadre which is arbitrary and illegal.

The petitioners were applicants for the post of TGT Sanskrit pursuant to advertisement no.2 of 2023, Annexure P-1, under different unreserved/reserved categories for Mewat as well as Rest of Haryana cadre. (In CWP 19489-2024 the petitioners belong to BC-A and BC-B category; in CWP20566-2024 to EWS category; and in CWP-20907-2024 to General category.) A common written test was conducted for both the cadres. They were successful in the selection and, at the time of scrutiny of documents, were asked to give preference for the respective cadre(s) they wished to be considered against for selection and appointment. All of them opted for Rest of Haryana cadre as their first preference. As per final selection result, they have secured more marks than those of the last selected candidate(s) in Rest of Haryana cadre, still the appointments have been offered to them in Mewat cadre. 2.
Pursuant to the interim order passed by this Court, learned State counsel has produced the petitioners' result as well as scrutiny forms, a perusal whereof shows that all the petitioners have secured more marks than those of the last selected candidates in their respective categories, and have opted for Rest of Haryana cadre as first preference. In view of these undisputed facts, it appears that due to an error or mistake on the respondents' part the petitioners have been allocated Mewat cadre instead of Rest of Haryana, which they are entitled to as per the preference given, as also on merit. 3.
Accordingly, the petitions stand disposed of with a direction to the Commission to correct the error/mistake, and recommend the petitioners for appointment as TGTs Sanskrit in Rest of Haryana cadre in their respective
-3categories as per merit. The second respondent shall, thereupon, offer appointment(s) to the petitioners, subject to their fulfilling the requisite conditions, from the date other selected candidates pursuant to the selection in question have been appointed. The directions shall be carried out by the respondents within a period of four weeks from receiving a certified copy of the order.
