Prayer in this petition, filed under Section 438 of the Code of Criminal Procedure, 1973, is for grant of anticipatory bail to the petitioner, who has been booked for having committed the offences punishable under Sections 323, 341, 506, 148 and 149 IPC (Section 307 IPC was added lateron), in a case arising out of FIR No. 123, dated 13.08.2022, registered at Police Station Dhanaula, District Barnala. On advance notice, Mr. J.S. Arora, Deputy Advocate General, Punjab, and Mr. Yagsimant Attri, Advocate, for the complainant, are present in the Court.

Looking at the factual aspects of the matter, learned counsel for the petitioner seeks permission to withdraw the present petition by stating that in case, petitioner surrenders before concerned Court within PRASHANT KAPOOR 2022.09.27 19:06 I attest to the accuracy and authenticity of this order/judgment

CRM-M-44485-2022 next ten days and file an application for regular bail, same may be decided at the earliest.

In view of the stand of learned counsel for the petitioner, present petition is dismissed as withdrawn.

However, it is made clear that in case petitioner surrenders before concerned Court within next ten days and moves an application for regular bail, same be decided expeditiously preferably within a week from the date of filing of application.
