Learned counsel for the petitioners submits that in the present petition, the claim of the petitioners is that their services on ad-hoc basis prior to regularization of their services are to be treated as valid service for the purpose of seniority.

Learned State counsel submits that the petitioners are claiming the benefit of seniority on the basis of the adhoc service rendered by the petitioners but keeping in view the judgment of the Hon'ble Supreme Court of India in Malook Singh and others vs. State of Punjab and others 2021

(4) SCT 305, the benefit of adhoc service cannot be given towards seniority, hence, the present petition is liable to be dismissed. 3.

Learned counsel for the petitioners has not been able to rebut the fact that the question of law raised in the present petition is squarely covered by the judgment of the Hon'ble Supreme Court of India in Malook Singh's case (supra).
