RAMENDRA JAIN, (ORAL) Through this revision, petitioner-landlord has assailed order dated 19.08.2019 (Annexure P-1) of learned Rent Controller, Patiala, closing his evidence in affirmative by Court order. Learned counsel inter alia contends that learned Rent Controller, erroneously closed evidence of the petitioner in affirmative, under undue pressure, in view of the fact that eviction petition filed by petitioner had come in the category of 'action plan cases'. The petitioner may be afforded one effective opportunity to conclude his evidence, at his own responsibility.
Having given thoughtful consideration to the submissions of learned counsel for the petitioner and without commenting upon merits of the case, but in view of principles of natural justice, equity, good conscience and fair play, one effective opportunity is granted to the petitioner to conclude his evidence, at his own responsibility, subject to costs of `10,000/- which shall be paid to the opposite side. Disposed of accordingly.
